In the event of defamation, in fact, criminal proceedings – which are initiated under the impulse of the victim of the crime, who is charged with filing a lawsuit – are usually accompanied by civil proceedings, through which the victim intends to obtain compensation for the damages, whether economic or not, suffered. Sometimes, on the opposite, the victim considers it preferable not to file a lawsuit against the alleged offender but to act only in civil proceedings, as this second solution generally guarantees greater privacy as well as the satisfaction of claims in a shorter period of time.
In this context, the Firm offers assistance both in extra-judicial proceedings (in the drafting of rectification petitions) and in pre-litigation (in mediation proceedings which, in the event of defamation carried out through the press, is mandatory) and litigation, even in urgent proceedings which usually precede the claim for damages and which are aimed at obtaining the immediate removal of illegal content, especially when published online (on blogs and social platforms), in order to avoid the continuation of the damaging conduct.
